Terms and Conditions of Sale

Every purchase operation is regulated by the provisions of Legislative Decree no. 185 of 22/05/1999 "Implementation of Directive 97/7/EC on the protection of consumers in respect of distance contracts" and, as regards privacy protection, is subject to the provisions of Legislative Decree no. 196/2003.

This contract concerns the sale of products marketed by EBE Srls in the quantity and quality chosen by the consumer through online selection on the website www.leceramichedisassuolo.com 

From the moment the consumer accesses and uses the website www.leceramichedisassuolo.com they must examine and accept these conditions of sale before confirming purchases from the site. Therefore, submitting the order confirmation implies full knowledge of the conditions of sale and their full acceptance. We invite you to read them carefully and to print and/or save them on another durable medium of your choice, in order to fully satisfy the condition referred to in articles 3 and 4 of Legislative Decree no. 185/1999. The consumer may waive access to the website or proceed if they do not wish to accept and comply with these terms and conditions. PURCHASE METHODS  

Purchases of products, available as illustrated and described online in their respective descriptive sheets, are made at the price indicated therein, expressed in euros, excluding VAT. The prices displayed are valid only for Italy. Transport costs are not included in the price but are protected in part at the time of purchase. Before confirming the purchase, you will be given a summary of the unit cost of each selected product, the total cost in case of multiple products, and the related transport costs. By confirming the purchase, you will receive an email message containing the date and the total amount of your order and its details.
ORDERS AND INVOICING

Orders are accepted via online selection on the website www.leceramichedisassuolo.com The conclusion of the contract is subject to the Customer paying the full amount using one of the permitted payment methods.  

Those obliged to request an invoice must communicate their VAT number and all necessary data for its issuance. The tax invoice may also be issued after the delivery of the goods, within the terms established by law.
PURCHASE CONTRACTS STIPULATED BY MINORS

Purchases can only be made by adults. However, if a purchase is made by a minor providing false information regarding their age, or false indications to purchase the desired item and/or to access the desired data, the parents are directly responsible for the payment of what has been purchased, without prejudice to the right of withdrawal provisions reported in these terms of sale.
PAYMENT METHODS

The prices on the website www.leceramichedisassuolo.com are valid only for Italy, are understood as excluding VAT, and include containers and packaging.  

The contribution for delivery costs is indicated at the time of purchase. Payment for purchased products and related shipping costs can be made at the time of order confirmation using one of the available Credit Cards indicated online.

Purchasing through the use of a Credit Card requires entering the card details. EBESrls, in order to offer a higher guarantee to its customers, uses a secure transaction system, with the primary task of ensuring the confidentiality and reliability of communications between the buyer's computer and the bank's server, through data encryption.
DELIVERY METHODS

For e-commerce service, EBESrls only delivers in Italy, using specialized Couriers. Purchased products are delivered directly to the address indicated during the purchase procedure. Each shipment contains the ordered goods and the relevant accompanying documentation.

Delivery times may vary depending on the availability of the goods.

Upon delivery, the Customer is required to verify that the package is intact and not damaged. Only after this verification should they accept the delivery, otherwise they will be required to reject the package. If the goods arrive at their destination broken or damaged, EBE Srls undertakes to replace the product at its own expense, only and exclusively if the recipient has confirmed the breakage or damage in the presence of the courier who made the delivery or if they have indicated "ACCEPTANCE WITH RESERVE" on the receipt document.

In the event of a discrepancy between the order and the delivery, the Customer must raise a dispute by contacting EBE Srls by sending an email to customer service at info@ebe.it 

METHOD OF EXERCISING THE RIGHT OF WITHDRAWAL

EBE Srls guarantees the right to withdraw from the purchase contract, referring to Legislative Decree no. 185 of 22/05/1999 "Implementation of Directive 97/7/EC on the protection of consumers in respect of distance contracts" and subsequent amendments.

The Customer may exercise the right of withdrawal no later than 10 working days from the date of receipt of the goods. This right must be exercised by sending a written communication by registered letter with acknowledgment of receipt to EBE Srls, Via Clelia, 18 – 41049 Sassuolo (MO). The communication can also be sent, within the same period, by email addressed to info@ebe.it , provided that it is confirmed by registered letter with acknowledgment of receipt within forty-eight (48) hours. 

The goods must be returned to EBESrls intact, in unaltered conditions, and complete with their original packaging, at the Customer's expense, no later than 15 days from the communication of withdrawal. EBE Srls will re-credit the sums paid (including initial shipping costs in the case of total withdrawal from the order) within a maximum of 30 days from the date on which EBE Srls became aware of the Customer's exercise of the right of withdrawal and, in any case, not before having received the returned shipment and checked the condition of the goods subject to withdrawal. The costs and risks associated with returning the products will be borne by the buyer. It should be noted that Community legislation provides that the right of withdrawal can only be exercised by natural persons (consumers) acting for purposes that can be considered unrelated to their commercial activity.

The right of withdrawal, therefore, CANNOT be exercised by legal entities and individuals acting for purposes related to a commercial activity. Also excluded from the right of withdrawal are purchases made by resellers or by subjects who, for any reason, purchase for resale to third parties. The right of withdrawal does not apply to the supply of goods made to measure or clearly personalized or which, by their nature, cannot be returned or risk deteriorating or altering rapidly. It is also specified that, in cases of premium operations (so-called promotions), where the purchase of one good is combined with another good that is sold at a negligible price or even given away, the right of withdrawal will be legitimately exercised with the return of both goods subject to the purchase, given the accessory nature of the promotional good with respect to the first.

For any report, complaint or support request, you can directly contact info@ebe.it citing the order number assigned at the conclusion of the order and shown in the order confirmation sent by email. LIMITATION OF LIABILITY  

1.     EBE Srls assumes no responsibility for errors and omissions within www.leceramichedisassuolo.com or any website to which it may refer or link.  
2.     EBE Srls reserves the right to continuously update the website www.leceramichedisassuolo.com which may be carried out at any time. The information may contain inaccuracies of any kind or typographical errors.  
3.     EBE Srls does not guarantee that the services provided by www.leceramichedisassuolo.com will be rendered without interruptions, this will be announced in advance except for causes not depending on the will of EBESrls  
4.     EBESrls is solely responsible for evaluating the accuracy, completeness and usefulness of what is provided through the website www.leceramichedisassuolo.com 
5.     EBE Srls disclaims any liability towards the buyer or third parties for indirect, incidental, consequential, punitive or exemplary damages (including, but not limited to, loss of profits, revenues, business opportunities) arising from or in connection with a product or service provided by EBE Srls, or from the use or inability to use the same.
6.     EBE Srls assumes no responsibility for disservices attributable to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that prevent, in whole or in part, the execution of the contract within the agreed times. EBESrls will not be liable to any party for damages, losses and costs suffered as a result of the non-performance of the contract for the reasons mentioned above, the Customer being entitled only to the refund of the price paid.
7.     Without prejudice to cases of fraud or gross negligence on the part of EBE Srls, it is hereby agreed that, if its liability is ascertained for any reason towards the Customer, including in the case of total or partial non-fulfilment of the obligations assumed by EBE Srls towards the Customer as a result of the execution of an order, the liability of EBESrls shall not exceed the price of the Products purchased by the Customer and for which the dispute arose.

USER RESPONSIBILITY

The User is required to ensure that their entered data is truthful, complete, up-to-date and to promptly communicate any changes to it. In the event of false declarations, the benefits obtained from the services provided will be lost. EBESrls reserves the right to remove such subjects from its user lists, after a formal invitation to self-correction has not been sent.
COPYRIGHT AND TRADEMARK

Given that the pages of www.leceramichedisaasuolo.com do not intend to intentionally reproduce any copyrighted material or in violation of the law; furthermore, given that for any original and protected material published on www.leceramichedisassuolo.com the source is cited, if a violation of copyrighted material is found, whoever holds it is required to notify the Staff of www.leceramichedisassuolo.com (via e-mail to: info@ebe.it ) who will immediately investigate and resolve, once the situation has been verified, by removing such content. Furthermore, it is declared that all the contents of the website www.leceramichedisassuolo.com, such as texts, files, tables, information present within the site's pages, graphic elements, HTML, logo, buttons, icons, images, graphics, audio-video clips, documentation (meaning the collection, arrangement and assembly), all software, source codes, application projects, formulas, algorithms, databases, etc., used on the site are to be considered the exclusive property of EBE Srls or its content and product suppliers and are protected by national (Law 663/1941 and subsequent amendments) and international laws on copyright, patents and those relating to intellectual and/or industrial property; the user cannot modify, duplicate, distribute, transmit, reproduce, publish, license, create derivative works, transfer or sell information, software, products or services obtained from this website even without profit. Any use other than that provided for in these "General and Contractual Conditions of Sale of EBESrls on www.leceramichedisassuolo.com, including the reduction, modification, distribution, transmission, reproduction, display or performance of the contents of this site, is prohibited and any unauthorized use of the resources present on www.leceramichedisassuolo.com constitutes copyright infringement, unless it is a more serious offense, and exposes the responsible party to the relative civil and criminal consequences provided for by articles 171, 171-bis, 171-ter, 174-bis and 174-ter of law 633/1941 and subsequent amendments PRIVACY            

Pursuant to art. 13 of Legislative Decree 196/2003 "Code regarding the protection of personal data", we inform the Customer that the primary purpose of processing the data provided to EBE Srls during registration on this site is to register the user and conclude the sale transaction. The provision of data is optional, but any refusal to provide it makes it impossible to perform the online shopping service.

The personal data provided is collected by electronic means and processed, also with the aid of electronic means, directly and/or through delegated third parties (companies for home delivery, for mailing and for data entry) for the following purposes:

•     administrative management of orders and purchases;
•     management of any participation in loyalty programs
•     statistical purposes related to the detection of purchasing behavior
•     sending of advertising material relating to products and offers through the use of newsletters, sms, mms.

Access to customer information may be granted to specifically appointed individuals such as employees or collaborators who need it for the performance of their duties or by virtue of their position, with full knowledge of privacy regulations and personal data processing, for processing necessary or connected to order fulfillment, sending communications and advertising material, and gifts. Third-party service providers (appointed, external managers or independent data controllers) strictly functional to the execution of the contractual relationship may also be involved, such as: carriers for home delivery, companies that provide payment services, other group companies, company consultants, data entry companies, call centers, etc.

In any case, EBESrls undertakes not to communicate or disseminate the collected data to subjects not necessary for the performance of the above services and not to carry out unnecessary, irrelevant and excessive processing beyond contractual requests. Pursuant to art. 7 of Legislative Decree no. 196/2003, the Customer has the right to obtain confirmation of the existence or not of personal data concerning him and its communication in an intelligible form. He has the right to obtain indication:

1.     of the origin of the personal data;
2.     of the purposes and methods of processing;
3.     of the logic applied in case of processing carried out with the aid of electronic instruments;
4.     of the identity of the owner, managers and the representative designated pursuant to article 5, paragraph 2;
5.     of the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of it as designated representative in the territory of the State, managers or appointees.

You have the right to obtain:

1.     the updating, rectification or, when interested, the integration of the data;
2.     the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including those whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed;
3.     certification that the operations referred to in letters a) and b) have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, except in the case in which such fulfillment proves impossible or involves a manifestly disproportionate use of means compared to the protected right.

You have the right to object, in whole or in part:

1.     for legitimate reasons to the processing of personal data concerning him, even if pertinent to the purpose of collection;
2.     to the processing of personal data concerning him for the purpose of sending advertising material or direct sales or for carrying out market research or commercial communication.
